نظام تاديب الموظف العمومي في التشريع الجزائري

Abstract

الملخـص يخضع موظفو المؤسسات والإدارات العمومية إلى نظام تأديبي خاص يحكمه الأمر رقم 06-03 المتضمن القانون الأساسي العام للوظيفة العمومية، كما يخضع القاضي إلى نظام تأديبي يحكمه القانون العضوي رقم 04-11 المتضمن القانون الأساسي للقضاء، والقانون العضوي رقم 04-12 يتعلق بتشكيل المجلس الأعلى للقضاء وعمله وصلاحياته. وبالتالي فإن الموظف العمومي والقاضي ملتزمان بالخضوع لهذا النظام التأديبي الذي يتكون من مجموعة القواعد القانونية والتنظيمية الآمرة، التي ينتج عن مخالفتها التعرض للجزاءات التأديبية المقررة قانونا، التي تقرّها في حقهم السلطة المخولة بالتأديب. وفي مقابل ذلك كفل المشرع للموظف العمومي والقاضي في المجال التأديبي حماية من تعسف السلطة التأديبية من خلال منحهم ضمانات سابقة ومعاصرة ولاحقة على توقيع العقوبة. Résumé: Les fonctionnaires exercant au sien des institution et administrations publique sont soumis a un régime disciplinaire spécial est régie par l’ordonnance n° 06-03 contenant le statut général de la fonction publique , pour le poste de juge est soumis a un systém disciplinaire régie par la loi organique n° 11-04 contenant la loi fondamentale de la magistrature et le regard loi organique n° 04-12 a la formation du consiel CSM et son travaile et ses pouvoire. Et l'agent public et le juge engagé à soumettre au système disciplinaire, qui se compose d'un ensemble de règles juridiques et jus réglementaires et que les résultats de violer l'exposition à des sanctions disciplinaires prévues par la loi, approuvé par le droit autorité conférée à la discipline et en retour garanti législateur pour l'employé et le juge dans la zone protection disciplinaire de l'autorité disciplinaire arbitraire à travers le passé et les garanties.
