| Résumé: | تدور فكرة هذه الأطروحة حول بيان ماهية التنازل عن الحق للغير بعوض مالي، ودليل مشروعيته وطبيعته الفقهية وأقسامه، كما أبرز الباحث بعض المصطلحات الفقهية القريبة من مصطلح التنازل وبين علاقته بها، وهو ما حاول توضيحه في هذه النقاط ، وقد جاءت الأطروحة في مقدمة خمسة فصول وخاتمة ، كانت الفصول في بيان مفهوم التنازل عن الحق بعوض وعلاقته ببعض المصطلحات الفقهية الأخرى، و في مشروعية التنازل عن الحق بعوض، وطبيعة عقد التنازل عن الحق بعوض وأقسامه، وفي بيان الحقوق وقابليتها للتنازل والعوض ، و في نماذج تطبيقية من مسائل الأحوال الشخصية، وأما الخاتمة فقد ضمنها أهم النتائج والتوصيات . |
| Description: | The idea of this thesis revolves around explaining what is the assignment of the right to others with a financial compensation, and evidence of its legitimacy and the nature of jurisprudence and its divisions. The researcher also highlighted some jurisprudential terms close to the term of assignment and explained its relationship to it, which he tried to clarify in these points, and the thesis came in an introduction, five chapters In conclusion, the chapters were in explaining the concept of assigning the right to compensation and its relationship to some other jurisprudential terms, and in the legality of assigning the right to compensation, the nature of the contract of assignment of the right to compensation and its divisions, and in explaining the rights and their ability to assign and remuneration, and in practical examples of personal status issues, and as for The conclusion included the most important findings and recommendations. |
