Abstract

الملخص

يعتبر القانون رقم 10-03 المتضمن استغلال الأراضي الفلاحية التابعة للأملاك الوطنية الخاصة خطوة هامة خطاها المشرّع الجزائري من أجل ضمان استغلال الأراضي الفلاحية،وذلك من خلال تبنيّه لعقد الامتياز،حيث تم تحويل حق الانتفاع الدائم الذي كان منظما بموجب القانون رقم 87-19 الملغى إلى عقد امتياز والذي يمنح بموجبه المستثمر صاحب الامتياز الذي تتوفر فيه مجموعة من الشروط،الحق في استغلال المستثمرة الفلاحية لمدة 40 سنة قابلة للتجديد مقابل دفع إتاوة سنوية،ويكون هذا الاستغلال تحت رقابة الدولة ممثلة في الديوان الوطني للأراضي الفلاحية،حيث ساهم هذا القانون في حماية الأراضي الفلاحية الغير مستغلة والتي حوّلت عن وجهتها الفلاحية Résumé :

La législateur algérienne a pris une décision importante pour assurer l’exploitation des terres agricoles en créant la loi n° =10-03 contenant l’exploitation des terres agricoles de la propriété nationale ; ainsi qu’elle a adopté le contrat de concession en convertissant le droit d’utilisation permanente qui a été organisé en vertu de la loi n°= 87-19 abrogé au contrat de concession qui accorde a l’investisseur concessionnaire le droit d’exploiter le paysan investi pendant 40 ans renouvelables en payant une redevance annuelle ;cette exploitation soumis a un contrôle de la société office national des terres agricoles ;cette loi a contribué a la protection des terres agricoles inexploité. Law No.10-03 containing the exploitation of agricultural lands of the national property is an important step by the Algerian legislator in order to ensure the exploitation of agricultural land, through the adoption of the concession contract, which has been transferred the right of permanent use, which was organized by law No.87-19 to the repealed concession contract, which gives the concessionaire investor the right to exploit the investing farming for 40 years,whith paying an annual royalty under the control of the state represented by the National Office of agricultural land, this law contributed to protect the agricultural land untapped.
