الرقابة الداخلية والخارجية على الصفقات العمومية في التشريع الجزائري

Abstract

الملخص : تعد الصفقات العمومية من أهم العقود الادارية، المنظمة بنظام قانوني مميز عمل المشرع الجزائري على تطويره وذلك بإدخال تعديلات كثيرة عليه، كما خصها برقابة خاصة والتي تقوم بهذه الأخيرة أجهزة مختصة سواء على مستوى الرقابة الداخلية أو الخارجية والهدف من ذلك حماية المال العام، خاصة في ظل توجه الدولة نحو اقتصاد السوق وهو مايظهر لنا أهمية ترشيد و تسيير الأموال العامة والحفاظ عليها ومواجهة أي مساس بها بصرامة ومن خلال الدراسة التي قدمت و المجسدة في الرقابة الداخلية والخارجية على الصفقات العمومية Résumé : Les marchés publics sont considérés comme les plus important contrats administratifs ,et sont organisés par un règime juridique spécifique que le législateur algérien a pencher sur sondeveloppement en introduisant plusieures modifications pour l’amender. Pour cela un control spécial est reservé par des organes appropriés sur l’espace interne et externe dans lebut de présérver les demiers publics ,dans le contexte de parcourir une économé de marché a cet effet , la rationalisation et la sauvgarde des fonds publics est obligation pour faire face à tous préjurdice y subir et l’étude que j’ai fournie ma permet de soulever l’importance du control interne et externe des marchés publics. Summary: Public contracts are considered the most important administrative acts, organized by a specific legal regulation that the Algerian legislature is working on its development by introducing many changes to be made, they are characterized by a distinctive control and this control is carried by specialized bodies on both of the level of internal and external control in order to protect public funds,in particular that the state moved towards a market economy, which shows us the importance of streamlining, management and maintenance of public funds, and face, harshly, to suffer any harm there, and the study that I provided, incorporated in the internal and external control of public contracts.
