Abstract

Abstract: Algerian Constitutionnel Council was able to take advantage of the available opportunities; this is especially when controlling some legal texts focusing on the performance of the main task given to it, which is the protection of the Constitution, particularly when it banned several legal texts affecting the rights and freedoms recognized by the Constitution. In addition to this, it has the ability and role to perform as a judge over the elections, in presidential elections, legislative and referendum. However, through the Council’s performance to its functions, it has proven that there are many obstacles in its way to realize its full tasks, and perhaps the most important is the asymmetrics election of its members, except that these imperfections were corrected in the amendment of the Constitution in 2016, till achieving greater efficiency. Résumé : Le Conseil constitutionnel algérien a été en mesure de saisir les opportunités offertes à lui, quand son contrôle sur certains des textes juridiques, en mettant l'accent sur la performance de la tâche qui lui est attribué qui assurent la protection de la Constitution, surtout quand il a passé l'inconstitutionnalité de plusieurs des dispositions qui affectent les droits et libertés reconnus par la Constitution, permet également au Conseil l'activation du rôle de juge des élections, dans les différents élections présidentiels et législatifs et référendum, en surveillant ces élections.Mais la réalité est par l'exercice des fonctions du Conseil a prouvé qu'il existe de nombreux obstacles à la réalisation de ses tâches, et peut-être la sélection asymétriquede ses membres le plus important, cependant, ces lacunes ont été corrigées dans la modification de la Constitution en 2016, en attendant une plus grande efficacité de cet organe. ملخص: تمكن المجلس الدستوري الجزائري من انتهاز الفرص التي اتيحت له، عند رقابته على بعض النصوص القانونية، بتأكيده على أداء المهمة المنوطة به وهي السهر على حماية الدستور، خاصة عندما قضى بعدم دستورية العديد منها، التي ارتأى بأنها تمس بالحقوق و الحريات المقررة دستوريا؛ كما تمكن المجلس من تفعيل دوره كقاضي انتخابي، في مختلف الاستشارات الانتخابية رئاسية و تشريعية و استفتاءات، من خلال سهره على صحة هذه الانتخابات، و فصله في الطعون المقدمة بشأنها. غير أن الواقع و من خلال ممارسة المجلس لوظائفه أثبت بأن هناك عوائق عديدة تحول دون تحقيقه للأهداف التي أسس من أجلها؛ و لعل من أبرزها نظام الإخطار الدي كان مجاله ضيقا و كذا التشكيلة غير المتوازنة لأعضائه ، إلا أن هذه النقائص تم تداركها في التعديل الدستوري لسنة 2016 بانتظار فعالية أكبر لهذه الهيئة
