Abstract

الملخــص: نظرا لأهمية العقد التجاري الدولي وما يتسم به من تعقيد وتركيب، فهو يحتاج إلى مرحلة من التفاوض تسبقه وتمهد له مما استدعى تحديد الطبيعة القانونية لهذه المرحلة، وما يترتب عليها من التزامات تتمثل في الالتزام بحسن نية ومقتضياته وقيام مسؤولية مدنية عند إخلال الأطراف بالتزاماتهم، وتحديد القانون الواجب التطبيق عند قيام هذه المسؤولية، لاسيما وأننا في إطار دراسة موضوع ذو طابع دولي.
