دور مجلس الأمن في تنفيذ قواعد القانون الدولي الإنساني

Abstract

الملخص يعتبر مجلس الأمن أحد الأجهزة التابعة لمنظمة الأمم المتحدة،حيث خول له الميثاق مهمة حفظ السلم و الأمن الدوليين ، مانحا إياه اختصاصات و سلطات مهمة تساعده على تنفيذ تلك المهمة سواء بطرق سلمية والمتمثلة في الفصل السادس من الميثاق أو بطرق قمعية المتضمنة في الفصل السابع. كما نجده أيضا يتحرك ليتواجد في ساحات الانتهاكات، محاولا إتحاد تدابير وإجراءات من شأنها إعادة الاستقرار وقمع الانتهاكات وهو ما أطلق عليه آليات مجلس الأمن التي يساهم من خلالها في تنفيذ القانون الدولي الإنساني وقد شملت هذه الآليات نوعين آليات ذات طابع غير قضائي ، وآليات ذات طابع قضائي. ويحاول كذلك مجلس الأمن تنفيذ قواعد القانون الدولي الإنساني من خلال جهوده في إرساء القضاء الجنائي الدولي الدائم، وذلك في إطار علاقته بالمحكمة الجنائية الدولية، باعتبارها أول محكمة جنائية دولية ذات طابع دائم. Résumé Le Conseil de sécurité est considéré comme l'un des organes des Nations Unies, où autorisé sa mission de charte pour la paix tenue et la sécurité internationales, en lui donnant les termes de référence et la tâche des autorités pour l'aider sur la mise en œuvre de cette tâche, que ce soit par des moyens pacifiques et du Chapitre VI de la Charte ou répressive inclus façons au chapitre VII.
