آليات تطبيق القانون الدولي الإنساني

Abstract

الملخص: يسعى القانون الدولي الإنساني إلى التخفيف من ويلات الحروب, و هذا بتوفير الحماية و المساعدة للمقاتلين العاجزين عن القتال و للذين لا يشاركون في القتال أصلا,و كذا توفير الحماية للأعيان المدنية و الممتلكات الثقافية. كما أن لقواعد القانون الدولي الإنساني طابع إلزامي و طابع جزائي يعاقب من يخالفه,و لهذا القانون العديد من الآليات التي تضمن تطبيقه سواء على الصعيد الدولي كالدولة الحامية و اللجنة الدولية للصليب الأحمر,واللجنة الدولية لتقصي الحقائق,و دور الأمم المتحدة كآلية لتطبيق القانون الدولي الإنساني و كذا دور القضاء الجنائي الدولي ممثلا أساسا في المحكمة الجنائية الدولية,أما على الصعيد الوطني فنجد التزام الدولة بإصدار التشريعات اللازمة لتطبيق القانون الدولي الإنساني ضمن قوانينها الداخلية,إضافة إلى الالتزام بنشر قواعده على أوسع نطاق لتحقيق علم كافة أفراد المتجمع به,و كذا تأهيل العاملين المؤهلين و المستشارين القانونين لتسهيل تطبيق قواعده. Résumé Le droit international humanitaire tente de limiter les effets des guerres , on offrant une protection et un soutien aux combattants incapables de combattre et qui ne participent pas aux guerres , et en apportant également la protection aux agents civiles et propriétés culturelles . Les règles du droit international humanitaire ont un caractère obligatoire et peuvent exposer à des sanctions pour toute enfreinte , ce droit compte plusieurs organismes et structures garantissant son application sur le plan international tel qu' un état protecteur , un comité international de la croix rouge et la commission international d' établissement des faits sans omettre le rôle important que joue les états unis en qualité de mécanisme d' application du DIH ainsi que le rôle du droit pénal international représenté principalement par le tribunal pénal international . Quand au plan national nous constatons l' engagement de notre pays à établir une législation nécessaire à l' application du DIH dans ses règlements intérieurs , et son engagement à publier ses lois sur la plus large marge possible afin qu'elles soient portées à la connaissance de tous les membres de la société et afin d' habiliter les employés qualifiés et les conseillers juridiques compétents à faciliter leurs application Abstract International Humanitarian Law ( IHL ) seeks to limit the effects of armed conflict by protecting persons who are not participating in hostilities and not involved in wars and also by protecting civil agents and cultural properties . The rules of International Humanitarian Law are mandatory and any violation may expose penalties . The IHL counts several mechanisms which guarantee its application at the international level such as the protective state , the international committee of the red cross and the Inernational Fact – Finding , in adition to the important role of the United States as a mechanism of IHL application and the role of the criminal law represented by the international penal court . At the national level , we see the commitment of our country to establish legislation necessary for the application of IHL in its internal regulations , and its commitment to establish its laws widest margim so that they become known from all the members of society and in order to empower qualified employees and competent legal advice to facilitate their implementation .
