dc.description	The research study dealt with a legislative asset derived in the section of evidence, which is the evidence of companionship, which was singled out by the fundamentalists to research and discuss its issues, and jurists deduced from it a number of jurisprudential rules on which jurisprudence built a number of principles and legal rules in the texts of law and judicial decisions, such as: the principle of the origin of innocence, the principle of judicial certainty, and others, which had an impact on their applications in the branches of law so that the research highlights a comparison between its jurisprudential and legal applications, and then a conclusion of the most important results and recommendations	en_US
dc.description.abstract	جاءت دراسة البحث تتناول أصلا تشريعيا في باب الأدلة، وهو دليل الاستصحاب الذي خصه الأصوليون بالبحث والمناقشة في مسائله، واستنبط الفقهاء منه عددا من القواعد الفقهية التي بنى عليها الفقه القانوني عددا من المبادئ والقواعد القانونية في نصوص القانون والقرارات القضائية مثل: مبدأ أصل البراءة، ومبدأ اليقين القضائي، وغيرها، التي كان لها الأثر في تطبيقاتها في فروع القانون بحيث جاء البحث يبرز مقارنة بين تطبيقاته الفقهية والقانونية، ثم خاتمة لأهم النتائج والتوصيات.	en_US
